This privacy policy (the “Privacy Policy”) describes the privacy practices of Mills Properties Inc. and its affiliated entities (“Mills Properties,” “we,” “us,” or “our”) with information we collect from persons or entities (“you”, “your”, or “users”) who access websites for the properties that we manage or related mobile applications that may be available for download (collectively, the “Site”).

Purpose

The purpose of this Privacy Policy is to inform you about the types of information we gather about you, including information gathered when you visit the Site, how we may use and disclose that information, the choices you have regarding our collection, use and disclosure of information, and your ability to correct the information in our records. Any Personally Identifiable Information provided to us through our Site will only be collected, used and disclosed in accordance with this Privacy Policy, unless you agree to an updated Privacy Policy.

By accessing our Site and/or by registering an account on the Site, you agree to the terms of this Privacy Policy and consent to the collection, use and disclosure of information in accordance with the terms of this Privacy Policy. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.

Children

The Site is not intended to solicit information from minors (people under eighteen (18) years old) or to seek to determine whether the visitor is a minor. If you are under eighteen (18), you are not permitted to submit to us any Personally Identifiable Information. Anyone under eighteen (18) who wants to obtain any product from Mills Properties or otherwise submit any Personally Identifiable Information to us should ask a parent or guardian to do it in his/her own name.

If we learn we have collected or received Personally Identifiable Information from a child under the age of 13, we will delete that information from our records.

Types of Information Collected

For the purposes of this Privacy Policy, “Personally Identifiable Information” means information that identifies you or can be used to identify or contact you.  We may collect Personally Identifiable Information such as your name, email address and phone number if you choose to provide it to us. For example, we may collect such information when you contact us about our properties or create an account on the Site. We (or our third-party service providers) may also collect your banking and/or credit card information to process a payment for a transaction you have authorized through the Site.

We may also automatically collect information that, by itself, typically cannot be used to identify or contact you, such as your demographic information (e.g. age, profession or gender), browser types, domain names, internet service providers, referring/exit pages, date/time of visits to the Site, operating system, clickstream data, other information about how you use the Site and your communication preferences, and other anonymous statistical data involving the use of our Site (“Non-Personal Information”). 

You may choose not to provide your Personally Identifiable Information by not entering it on the Site; however, you will not be able to use certain services and features of the Site if those services and features require Personal Identifiable Information in order to function.

If you do not want us to collect Non-Personal Information, do not visit the Site.

  • We may retain Personally Identifiable Information in our records unless you ask that we delete such information from our records.
  • If you provide any Personally Identifiable Information, you should only provide accurate, complete, and up-to-date information.
  • We will protect Personally Identifiable Information by using commercially reasonable security safeguards intended to protect against unauthorized access, disclosure, copying, or use.

 

How We Collect Your Information

We may collect information in several ways when you use this Site.

For example, we may collect Personally Identifiable Information via forms you submit to us via the Site, information you include in an application you complete on the Site, information you provide when scheduling a property visit through the Site, or any other activity through which you identify yourself to us via the Site.

We may also ask you to voluntarily provide us with Personally Identifiable Information on this Site. For example, while many of the features of the Site are available without registering, you may be asked to create an account on the Site if you desire to access certain features. Further, in some instances, we may ask you to provide Personally Identifiable Information in order to perform screening services.

Although you may decline to provide Personally Identifiable Information, some features, products and services will be unavailable to you as a result.
 

Non-Personal Information & Tracking Technologies

Mills Properties may use cookies, third-party analytics and other tracking mechanisms to customize content specific to your interests, track your use of the Site and better your experience with the Site. “Cookies” are text files that are placed on your computer and may be used to store your Personally Identifiable Information. In addition to cookies, we may use other now known or later developed technologies to assist us in observing the behavior of users visiting the Site. These technologies access information that is used only to compile aggregated statistics about the Site’s usage.

You can choose to delete existing cookies, allow or block all cookies, and set preferences for certain websites in your browser’s settings. Please note you may not be able to use the full functionality of the Site if you choose to block all cookies.

When you visit the Site, we (and our third-party service providers) may use these and other technologies to automatically collect certain information. For example, we use Google Analytics, which is a web analysis service provided by Google. Google utilizes the data collected from our Site, through cookies and similar technologies, to track and examine the use of the Site, to prepare reports on these activities, and share them with us. Use and Disclosure of Information

Wey may use the Personally Identifiable Information collected from you to provide services which you have requested from us, including, without limitation, enabling you to use the Resident Portal. We may also use your Personally Identifiable Information to contact you about our properties; to send you targeted messages, publications, news, and information about events, special offers, promotions and benefits; and to process and collect payments.

We will not disclose any information we collect from you to any third parties except as follows:

  • Affiliates: We may disclose your Personally Identifiable Information to any of our affiliates.
  • Service Providers: We may disclose your Personally Identifiable Information to our service providers that perform certain services for our business and/or Site (for example, data hosting, collection of payments), or they may directly have access to your Personally Identifiable Information as a result of the services they perform (e.g., website hosting, payment processing).
  • Legal Requests, Compliance & Protective Purposes: We may disclose your Personally Identifiable Information to respond to law enforcement requests or where required by applicable laws, court orders, criminal investigation, or government regulations. We may also disclose your Personally Identifiable Information to enforce compliance with our policies, to prevent illegal activity or suspected fraud, or to protect our Site, customers, or others.
  • Sale of Business. We might sell or buy subsidiaries, or business units. In such transactions, personally identifiable information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy. Also, in the event that our assets are sold, personally identifiable information may be one of the transferred assets.

We may use Non-Personal Information to help us run and maintain our Site, customize the visitor’s experience, study traffic patterns, generally learn about the usage of the Site.

We may use cookies and other technologies to maintain information about your use of our Site, help us recognize you when you visit our Site again, identify the website you visited immediately before visiting our Site, and enable us to evaluate and improve our Site design.


Protecting Your Personally Identifiable Information

The protection of Personally Identifiable Information is important to us. We make a commercially reasonable effort to prevent unauthorized use, disclosure, loss or theft of your Personally Identifiable Information, and inform employees who have access to your Personally Identifiable Information of the importance of keeping it confidential.

Be aware that no data security measures can guarantee complete security, so Information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure. As a result, we do not ensure, warrant or guarantee the security or integrity of such information. We will not be responsible for disclosure of any information due to errors in transmission or the unauthorized acts of third parties.

You should also take steps to maintain the security of your Personally Identifiable Information and protect against unauthorized access to your password, phone, and computer.


Do Not Track & Behavioral Advertising

This Site does not currently respond to “Do Not Track” signals, and does not authorize the collection of personally identifiable information by third parties or sharing of personally identifiable information with third parties except as provided in this Policy.
 

Accessing, Reviewing And Changing Your Personally Identifiable Information

You can see, review and change certain Personally Identifiable Information by logging into your account on the Site and editing your “Account Profile” or by contacting us at the addresses below. If your Personally Identifiable Information changes or is inaccurate, you must change it promptly via your “Account Profile” or by contacting us at the address below.

There may be circumstances where your Personally Identifiable Information is not accessible, reviewable or able to be modified by you through your account. With some exceptions, you have the right to see what Personally Identifiable Information we hold about you, though we may require to you provide sufficient information for us to verify your identity before providing such information to you. We can help you identify what records we might have about you. We may need to confirm your identity before providing you with this access, and we reserve the right in some instances to charge a nominal fee for such requests. In some cases, we may require that your request to us for access be made in writing. If we cannot give you access, we will tell you within 30 days or as soon as reasonably practicable and provide you with a reason, as best we can, as to why we cannot give you access.
 

Updates To This Privacy Policy

Mills Properties may revise this Privacy Policy at any time without notice. Should the Privacy Policy be modified in any way, the new Privacy Policy will be posted to the Site. As we may make changes from time to time without notifying you, we suggest that you periodically review the Privacy Policy. By using the Site after the effective date of any modification to the Privacy Policy, you expressly consent, without qualification, to the collection, use and disclosure of information, including Personal Identifiable Information (that you previously provided or later provide), as described in the new Privacy Policy.
 

Third-Party Websites

This Privacy Policy applies solely to information collected by Mills Properties. This Privacy Policy does not apply to other websites that are accessible through this Site but operated by any third-party.
 

Visitors From Outside the U.S.

Mills Properties operates a U.S.-based Site that is intended for U.S. users. This Policy governs the information collected by Mills Properties, including information collected at this Site, irrespective of where you are located when you access it, browse it, interact with it, or submit information to it. This means your Personally Identifiable Information  may be stored outside of the province, state, and/or country in which you reside (including in the U.S.), and processed by us, an affiliate or a third-party service provider as described in this Policy. Moreover, governmental and regulatory bodies that have jurisdiction (e.g., courts, regulators, and law enforcement agencies) may be entitled to access your Personally Identifiable Information.

If we learn that you are located in the EU and are accessing the Site, we will not intentionally collect any information from you without your consent and will delete all automatically collected information concerning your visit to the Site.
